Attorney Anthony M. Nosek |
|
Mr. Nosek has been engaged in the general practice of law since 1972 and joined Cohen & Lombardo in 1977. He led a trial and appellate practice before state and federal courts and before administrative agencies with a concentration in insurance law and environmental law. Mr. Nosek represented eight insurers with $128,000,000 limits of coverage in the Love Canal insurance coverage litigation (the Love Canal cases were the foundation for much of what is now the fundamental law of environmental law and environmental liability); represented municipalities and others in proceedings before the Department of Environmental Conservation in relation to consent orders for landfill closures; represented a swimming pool retailer in a quadriplegia personal injury case through the Court of Appeals resulting in a judgment dismissing the claim; represented a landfill in connection with the original landfill permitting process and through renewal hearings resulting in permit issuance and renewal; represented the C.I.D. companies as they grew from two trucks and two employees to the point where gross sales approached $50 million annually; represented the Village of Lancaster as both Village Attorney and as Village Justice; and, with partners, successfully represented a major manufacturer in defense of an attempt to certify a class action for injuries allegedly arising out of the use of urea-formaldehyde foam products. He has served as the Village Attorney for the Village of Depew since 2007.

In 1990, Mr. Nosek joined the C.I.D. Group, Inc. in Blasdell, NY as general counsel. While at C.I.D., Mr. Nosek was responsible for management, negotiations, acquisitions, municipal and private contracts, permit approvals and litigation. He represented the company in court and before administrative agencies and legislative bodies and supervised outside counsel. Mr. Nosek was responsible for the legal aspects of all company operations reporting to the President and the Chairman of the Board of Directors. He negotiated and prepared ash and MSW, hauling, and disposal agreements; landfill closure and post-closure escrow agreements; municipal and private waste transportation and disposal agreements; recycling agreements; disposal and waste brokerage agreements; collective bargaining agreements; contract extensions and assignments. He negotiated and documented real property acquisitions and sales. He assisted in the acquisition of several waste hauling businesses, and negotiated a joint venture agreement for landfill development. In 1997, Mr. Nosek negotiated and documented the sale of the C.I.D. companies.

In 1998, Mr. Nosek returned to the private practice of law at Cohen and Lombardo, P.C. He brings back with him unique experience as both a provider and consumer of legal services. In addition to providing legal services to the C.I.D. family businesses, Mr. Nosek provided services to the family which owned the businesses. He supervised the valuations reflecting both majority and minority ownership interests, planned lifetime giving to maximize the effective use of the unified estate/gift tax credit, created multiple classes of stock and drafted shareholder agreements to maintain control of the family enterprises, established split-dollar life insurance trusts, and implemented the creation of a family foundation. Whether the problem involves environmental, municipal, business, or personal issues, Mr. Nosek brings experience and proven success to bear on its resolution.
